At Passage Planning, we provide the following legal services.
Logistics Management for Seniors and Caregivers
Aging in Place Services for Seniors
(client resides in private home, condominium, apartment, assisted living accommodations)
A client centered approach to development of a daily logistics strategy. This should include the client and existing caregivers/family members including:
Connecting Seniors to Their Community
-Social engagement in community classes, programs, development of friendships, places of worship
-Accompany client to appointments (medical, social, vendors)
-Transportation strategies
-Development of interests/hobbies/group interactions
Finances and Technology Access
-Technology use/minimization/simplification and security against digital fraud (phone, tablet, computer and online applications)
-Financial access and potential stumbling blocks
-Daily Bill Paying, Credit Analysis, Debt Management and Budgeting
-Financial Management Monitoring (independent supervised spending)
Home and Wellness
-Medication review and pharmacy troubleshooting; follow up with client access to medical team
Interface with other professionals including geriatrician, internist, case managers, nurses, medical social workers, real estate professionals, housing staffing, therapists, home care aids and caregivers
-Reviewing general client and home care (Hygiene, basic tasks, yard care and safety)
-Observing client in home for possible referral to therapeutic aids (physical, occupational, emotional and spiritual support)
-Facilitating Family and friend connection, travel arrangements
-Support of specific nutrition/physical exercise plans
-Daily Bill Paying, Credit Analysis, Debt Management and Budgeting
-Financial Management Monitoring (independent supervised spending)
Trust Administration, Executor Duties and Executor Support
Serve as the named Successor Trustee, Estate Executor and/or professional assistant to a named Executor/Successor Trustee in completion of their duties.
Executor Duties:
The Executor makes sure all debts are paid, all taxes paid, all assets cared for, then distributes the remaining assets to the beneficiaries in accordance with law and the Will.
If legal action is brought against the estate, the Executor is in charge of defending. Further, if the Estate (or the testator) has a legal claim against a third party, the Executor is obligated to consider filing suit.
If the Executor contests a claim against the assets, there is a formal procedure for rejecting the claim and contesting it in court if necessary.
Other typical duties:
Locating all assets of the estate and caring for them.
Paying expenses necessary to maintain the assets.
Paying continuing expenses that are necessary to keep the assets secure such as mortgage payments, utility bills insurance.
Paying income taxes that may become due. Pay any other taxes rightfully due.
Handling day to day details such as terminating leases and other outstanding contracts, notifying banks and governmental agencies, etc.
Setting up the estate bank account and brokerage accounts as necessary to keep income flowing during the life of the estate.
Paying any estate taxes.
Locating heirs and keeping them advised of the progress of the estate. Filing requisite notices.
Supervising the distribution of the assets and filing the necessary petitions with the court.
Executor for Seniors without a Partner or Family
Particularly helpful where family is at a great distance or unable to serve due to age, personal demands or capacity.
Serve as the Healthcare Representative (AHCD agent) and Power of Attorney or Agent of the Power of Attorney.
Develop a strategy for home transition--house organization, estate clean outs, management of donations and auction sales, home improvements and deferred maintenance.
Develop a care plan with additional professionals to maximize mobility, general health and community/family engagement.
Fiduciary Services
A fiduciary's role may include roles as manager, trustee or guardian. It is also a nurturing bond of trust, concern, and attentive care-giving. A fiduciary seeks to support mental and emotional well-being; reduce the stress of changing circumstances or unexpected events; and, most importantly, help each client, and their families, enjoy a fulfilling life.

Consultation/Assessment
Complimentary 15 minute phone meeting Additional time to set client goals and develop a professional relationship will require an Intake Consultation $175.00/hour (Flat Fee)
Private Professional Fiduciary (California License #1383)
Fiduciary Services $205/hour
Work as Consultant, Agent of Power of Attorney, Power of Attorney, Executor, Attorney in Fact.
Duties may include: investigation of assets, real estate transactions, preparation of supporting documents at request of legal counsel and tax professionals, client communications, creation of inventories of assets, extraordinary estate representative services, including but not limited to pre-tax preparations and returns, asset and investment management, doctor appointments, case and care management, all client communications, including with family members, counsel, accountants, care managers, trust beneficiaries, intestate heirs, financial planners/advisors, banking institutions, facility administrators, doctors, dentists, and other professional communications.
Fiduciary Services (Complex) $250/hr
Trust Administration Services (Successor Trustee or Special Needs Trust) and Assets Under Management $220/hr or an annual percentage, whichever is greater.
Duties may include: investigation of assets, real estate transactions, preparation of supporting documents at request of legal counsel and tax professionals, client communications, creation of inventories of assets, extraordinary estate representative services, including but not limited to pre-tax preparations and returns, asset and investment management, trust beneficiaries, intestate heirs, financial planners/advisors, banking institutions.
The following percentage fees shall apply, with the annual percentage fees calculated for the market value of total trust assets. These percentage fees may be negotiated on high balance trusts (in excess of $1,000,000 asset value) All Assets Under Management percentages are annual, billed monthly on a pro-rated basis. Minimum Monthly Rate $500
Percentage Fees:
1.5% - On the first $1 Million, 1.0% - $1 Million to $3 Million, 0.75% - $3 Million to $8 Million, 0.5% - anything above $8 Million
Sales or the Transfer of Real Property 1%
Negotiating the realtor’s commission, refinance of a property, review and signing of the listing agreement, discussing inspections and signing disclosures, evaluating offers and counteroffers, all necessary arrangements for property improvements in preparation of sale/rental, signing the final seller documents. Post-sale risks and liabilities.
Personal Property Task Management: $75/hour
Sort, Downsize, Categorize personal property for future use, storage, donation or auction.
Trust/Court Accountings: $170/hour
Preparation of accountings, including organization and review of relevant statements
Bookkeeping and Staff Administrative Rate: $1oo/hour
Staff-related tasks, including but not limited to, shopping for clients, post office trips for overnight or certified mailings, scanning and organization of documents, reconciling accounts, monthly reports, accounts receivable, bill pay and bank deposits.
Court Appearances/Consulting: $250/hour
Attending hearings, including testifying in court.
Personal Property Task Management: $85/hour Staff rate: $35-50/hr
Sort, downsize, categorize personal property for future use, storage, donation or auction.

Probate Administration Services: Statutory probate fees for customary services are authorized under Probate Code §10810, and are computed on a fee base comprised of gross assets, plus receipts and gains, less losses, on the following schedule:
4% of the first $100,000
3% of the next $100,000
2% of the next $800,000
1% of the next $9,000,000
0.5% of the next $15,000,000
Court discretion after $25,000,000
In addition to statutory fees, pursuant to Probate Code §10811, extraordinary fees can be requested for services such as tax issues, real property sales and litigation. Though subject to court approval, extraordinary services are charged at the hourly rate of $220.
Notes:
• All hourly rates are billed to the 1/10th of the hour
Fees are invoiced monthly and paid from client funds. Fees paid from decedent estates or Conservatorship funds are only paid upon court approval (if required).
Fees charged may vary case-by-case, depending on circumstances.
This fee schedule is subject to change with reasonable and required notice.
• Normal travel time is billed at Fiduciary’s standard rate for one direction. Any long distance travel (over one hour) is billed at Fiduciary’s discretion.
• Travel costs will be passed through at cost for travel over one hour from Passage Planning.
• Please note that in the capacity(s) that we will be retained to serve, we may be required to engage the services of an independent attorney or other professionals to assist us and these costs are borne directly by the Trust, Conservatorship, Estate, Client, Corporation or other Legal Entity. These fees, costs and expenses are not part of this firm’s compensation and will be passed on at cost.

Kathy is a California Licensed Private Professional Fiduciary, Certified Estate Planner™ and recovering attorney. She is a member of the Professional Fiduciary Association of California, Peninsula Estate Planners Council and National Institute of Certified Estate Planners. Kathy holds degrees from Northeastern University School of Law and Santa Clara University. She has served as executor/personal representative/advisor in three states. Kathy also is the former owner of Just a Party Girl Productions LLC, a hospitality and event planning company. Kathy is a rare Bay Area native and makes her home in Palo Alto with her family.
